Banni Pashu Uchherak Maldhari Sangthan vs UoI – National Green Tribunal Order

Important order from five judge bench of the National Green Tribunal, Principal Bench in Banni Pashu Uchherak Maldhari Sangthan v. UoI, where the NGT has upheld the rights of the pastoralists in Banni grasslands in Gujarat and ordered for

removal of all encroachments within six months. However, it will be important to see what procedure is adopted for removing such encroachments.

The court also said the Maldharis will continue to hold the right to conserve the community forests in the area, granted to them as per the provisions in Section 3 of Forest Rights Act, 2006.
